Howsy Terms of Service

Effective date: October 27, 2026 · Version 1.0

These Terms of Service ("Terms") govern your access to and use of the Howsy mobile application and related services (the "Service"). The Service is published on the App Store by the team responsible for Howsy ("we," "us," or "our"). By creating an account, signing in, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance and eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms. The Service is for everyday choices and conversation; it is not a substitute for professional medical, legal, financial, or safety advice.

2. Accounts

You may sign in using Sign in with Apple or another supported method. You are responsible for the activity on your account and for maintaining the security of your device and credentials. You may delete your account from Settings. We may suspend, restrict, or terminate an account if we believe it violates these Terms, creates risk for other users, or is required by law.

3. Purchases and subscriptions

The current version of the Service does not offer paid purchases, subscriptions, or in-app purchases. If we introduce paid features, we will present the price, billing period, renewal terms, cancellation method, and refund rules before you complete a purchase. Purchases made through the App Store are also subject to Apple's terms and refund policies.

4. User content and community rules

You retain ownership of the questions, options, suggestions, replies, requests, messages, profile information, and photos you submit ("Your Content"). To the extent Your Content is transmitted to or stored by the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, adapt, and process Your Content as necessary to operate, provide, protect, and improve the Service, subject to these Terms and our Privacy Policy.

In the current build, questions, suggestions, requests, and chats are stored on your device. Your public profile and avatar may be transmitted to our service for account and profile functions. The Service may include sample content for demonstration and review.

You may not use the Service to harass, threaten, hate, impersonate, spam, sexually exploit, or violate the privacy or rights of another person. You may not post illegal content, share another person's private information without permission, or use the Service to harm minors. We may remove content, limit features, or suspend or terminate accounts that violate these rules. Report and block tools are available in the app. We do not endorse user content and do not guarantee that it is accurate, complete, or appropriate.

5. AI features

The current version of the Service does not include AI-generated or AI-assisted features. If we introduce AI features, we will provide additional disclosures about their role, limitations, and data processing before they become available.

6. Intellectual property and limited license

The Service, including its design, software, text, graphics, logos, and trademarks, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the Service except as permitted by law.

If you send us feedback or suggestions, you grant us the right to use them without restriction or compensation.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT CONTENT WILL BE ACCURATE OR RELIABLE. COMMUNITY CONTENT REFLECTS THE VIEWS OF ITS AUTHORS, NOT OURS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

9. Indemnification

You will defend, indemnify, and hold harmless us and our officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms or the rights of another person.

10. Governing law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules, except where mandatory consumer-protection laws of your place of residence provide otherwise.

11. Dispute resolution

Before filing a claim, you agree to contact us through the support channel shown on our App Store product page and give us a reasonable opportunity to resolve the dispute informally.

If we cannot resolve the dispute informally, you and we agree that any dispute arising from or relating to these Terms or the Service will be resolved by binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules, before one arbitrator, in Wilmington, Delaware. The arbitrator may award the same relief that a court could award on an individual basis.

YOU AND WE WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. All disputes must be brought individually.

This arbitration agreement does not prevent either party from bringing an individual claim in small-claims court, seeking injunctive relief in court to prevent unauthorized use or disclosure of intellectual property, or enforcing intellectual-property rights in court. If this arbitration provision is found unenforceable, the remaining parts of these Terms will continue to apply.

12. Changes

We may update these Terms from time to time. If we make material changes, we will provide notice in the app, on the App Store product page, or through another reasonable method before the changes take effect. Your continued use of the Service after the effective date means you accept the updated Terms.

13. Contact

Questions about these Terms may be sent to feedback@howsymosy.com.
